These Terms of Service ("Terms") govern your access to and use of the NIXEO website located at nixeo.shop (the "Site"), and any products, content, features, and services offered through it (collectively, the "Services"). The Services are operated by Leviathan Luxuries LLC, doing business as NIXEO ("NIXEO," "we," "us," or "our").

By accessing or using the Site, placing an order, creating an account, or subscribing to our email or SMS/RCS messaging programs, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 21 years of age, or the age of majority in your jurisdiction if higher, to purchase products from NIXEO or to opt in to our marketing communications. By using the Services, you represent and warrant that you meet this age requirement and that all information you provide to us is accurate and current.

2. About Our Products

NIXEO products, including the Electronic Botanical Diffuser and the Non-Electronic Smokeless Inhaler, contain 0% nicotine and are formulated from botanical ingredients. Our products are not tobacco products, are not intended to diagnose, treat, cure, or prevent any disease, and are not marketed or intended as smoking cessation aids. Product descriptions, imagery, and marketing claims on the Site are for general informational purposes only and do not constitute medical or health advice. Consult a physician before use if you have any health concerns.

3. Orders, Pricing, and Payment

All orders placed through the Site are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or product unavailability. Prices are listed in U.S. dollars and are subject to change without notice. You agree to provide current, complete, and accurate purchase and account information for all purchases made through the Site.

4. Shipping, Returns, and Refunds

Consent to receive these messages is not a condition of any purchase.

  • Supported carriers are not liable for delayed or undelivered messages. Carriers are not responsible for delayed or undelivered messages.

6. Intellectual Property

The Site and all content, features, and functionality therein, including the NIXEO name, wordmark, logos, product designs, packaging, graphics, and text, are the exclusive property of Leviathan Luxuries LLC and are protected by U.S. and international trademark, copyright, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Site or our branding without our prior written consent.

7. Prohibited Conduct

You agree not to: (a) use the Services for any unlawful purpose or in violation of these Terms; (b) attempt to gain unauthorized access to the Site, other accounts, or computer systems; (c) interfere with or disrupt the Services; (d) resell or redistribute NIXEO products without our authorization; or (e) submit false or misleading information, including regarding your age or identity.

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NIXEO AND LEVIATHAN LUXURIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless NIXEO, Leviathan Luxuries LLC, and our officers, employees, and agents from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles, unless otherwise required by applicable consumer protection law in your jurisdiction.

We may update these Terms from time to time. The updated version will be effective as of the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
